Although we make every effort to display the products accurately, your product may vary slightly from those images. 2.2. Product Descriptions: We take all reasonable care to ensure that all details, descriptions, and prices of products appearing on the website are correct. 2.3. Age Appropriateness: Our books and content are designed for children aged 3–16. It is your responsibility to ensure the product selected is suitable for the intended user’s age and needs.
3. Placing an Order and Contract Formation
3.1. Your Order is an offer to purchase a product from us. 3.2. Contract Formation: A contract between you and us will only be formed when we send you an email confirmation that we have dispatched the physical book(s) or provided access to the digital content (“Order Confirmation”). 3.3. We reserve the right to refuse any Order. If we are unable to accept your Order, we will inform you of this and will not charge you for the product.
4. Price and Payment
4.1. The price of the product will be the price displayed on the website at the time you place your Order. 4.2. All prices include VAT (where applicable) at the current UK rate. 4.3. The price does not include delivery charges, which will be calculated and displayed to you on the Checkout page before you confirm your Order. 4.4. We accept payment via Visa, Mastercard, American Express (AMEX), Discover, JCB, and UnionPay, as well as digital payment methods such as Google Pay and Apple Pay. 4.5. You must pay for the products and any applicable delivery charges before we dispatch the physical goods or grant access to digital content.
5. Delivery (Physical Books)
5.1. Delivery charges are as set out in our separate Delivery Policy, which is incorporated into these Terms. 5.2. We will deliver the goods to the address specified in your Order. We are not liable for any delay in delivery caused by the wrong delivery address being provided by you. 5.3. If your Order is for physical books, your product will be delivered within the estimated timeframes provided at Checkout.
6. Digital Content and Cancellation
This section is critical for compliance and to protect your digital product sales.
6.1. Access: Digital content (eBooks, audio files, etc.) will typically be made available for download or streaming immediately upon our Order Confirmation. 6.2. Licence: When you purchase digital content, you are granted a non-exclusive, non-transferable, personal licence to use the content for personal, non-commercial use only. You do not own the content. You must not copy, share, resell, or distribute the content. 6.3. Waiver of Cancellation Right (Consumer Contracts Regulations 2013): * By placing an Order for and commencing the download or streaming of digital content, you expressly request immediate performance of the contract and acknowledge that you lose your statutory right to cancel (the 14-day cooling-off period) once the download or streaming begins. * You will be required to acknowledge and consent to this waiver at the point of Checkout. 6.4. If digital content is defective, please refer to Section 8 (Warranties).
7. Returns and Refunds
7.1. Our policy on returns and refunds is set out in our separate Refund and Returns Policy, available at https://peterbates-holisticbooks.com/refund_returns/. 7.2. This policy complies with the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.
8. Warranties and Liability
8.1. We are under a legal duty to supply products that are in conformity with this contract. The Consumer Rights Act 2015 states that goods must be as described, fit for purpose, and of satisfactory quality. Digital content must be of satisfactory quality, fit for purpose, and as described. 8.2. If the product you receive is defective, please contact us immediately. 8.3. Limitation of Liability: We are not liable for any loss or damage not caused by us or for any business losses. Our maximum aggregate liability to you is limited to the total price paid for the products you have purchased from us. 8.4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or breach of your statutory rights as a consumer.
9. Intellectual Property Rights (IP)
9.1. All content on this website, including the text, graphics, logos, images, book content, and digital files, are the property of Peter Bates Holistic Books Limited and are protected by UK and international copyright laws. 9.2. You acknowledge and agree that you will not use any content from the website or products in any way that is inconsistent with these Terms or that infringes any of the Company’s IP rights.
10. Governing Law
10.1. These Terms are governed by and construed in accordance with English law. 10.2. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
